Welcome to tendermap.com ("TenderMap", "we", "our", or "us"), operated by SIA BMAP, a company registered in Latvia. These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, AI-powered features, and all related services (collectively, the "Platform"). By registering, accessing, or using TenderMap, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

TenderMap operates across eight countries: Latvia, Sweden, Estonia, Lithuania, Finland, Norway, Denmark, and Germany.

1. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding contracts under applicable law. By using the Platform, you represent that you meet these requirements. Companies and legal entities may use the Platform through authorised representatives.

2. User Types

Users of the Platform are classified into two categories, each carrying different legal rights and obligations:

  • Consumer: An individual acting outside the scope of any business, trade, or profession. Consumers benefit from mandatory consumer protection rights under applicable EU and national law, including rights that cannot be contractually waived.
  • Business User: A company, sole trader, or individual acting in a commercial or professional capacity. Business users do not benefit from consumer protection provisions (such as the 14-day withdrawal right) unless expressly stated. Business accounts must be created by an authorised representative of the entity.

3. Account Registration & Usage

  • Free Access: Signing up and using core features - including browsing tenders, basic supplier search, and listing projects - is free of charge.
  • Account Accuracy: You agree to provide accurate, complete, and up-to-date information during registration and to keep your credentials secure. You are responsible for all activity under your account.
  • AI-Powered Features: TenderMap provides AI-assisted tender search, supplier matching, and project recommendation features. These tools are provided as informational aids. Results are generated algorithmically and should be reviewed critically before acting on them.
  • Paid Features: Certain features - including Featured Listings, advanced AI matching, priority placement, and bulk export tools - require payment. Fees are disclosed clearly before purchase. For full guidance on using the Platform, visit our Help Centre.

4. Listings, Content & AI-Generated Suggestions

You retain ownership of the content you submit, but grant TenderMap a non-exclusive, worldwide, royalty-free licence to display, index, modify, and distribute it within the Platform for the purposes of operating and improving the service.

All listings and content must comply with these guidelines. We reserve the right to remove or suspend content that violates them, without prior notice:

  • Accuracy & Honesty: All listings, profiles, and submissions must be truthful. Misleading, deceptive, or fraudulent information - including misrepresented pricing, false ownership claims, or bait-and-switch content - is strictly prohibited.
  • Appropriate Content: Do not post illegal, violent, adult, or otherwise inappropriate content. Hate speech, harassment, and incitement to violence are prohibited across all jurisdictions where we operate.
  • Intellectual Property & Privacy: Do not reproduce others' content without permission. Respect all applicable copyrights, trademarks, and personal data laws.
  • Legal Compliance: Content must comply with applicable laws in the user's jurisdiction and in the country where the tender or project is located.
  • AI Suggestions: Content generated or suggested by AI features must still be reviewed by the user for accuracy before publication. TenderMap is not liable for errors in AI-generated suggestions that the user publishes without review.

5. AI Features & Disclaimer

TenderMap uses artificial intelligence to assist users with tender discovery, supplier matching, document summarisation, and project recommendations. These AI features are tools to support - not replace - professional judgment. By using any AI-powered feature on the Platform, you acknowledge that you are interacting with algorithmically generated outputs, that such outputs may be incomplete or inaccurate, and that you are solely responsible for independently verifying all AI-generated results before relying on them for any commercial, legal, or professional decision.

Important limitations:

  • AI results are generated based on available data and may not be complete, current, or accurate in all cases.
  • AI-assisted supplier matches and tender recommendations are suggestions only. Users must independently verify all results before making commercial decisions.
  • TenderMap does not warrant that AI outputs are free from error or bias.
  • Users in regulated industries (construction, public procurement, engineering) are responsible for verifying AI-generated content against official sources.

6. Paid Features & Pricing

Optional paid services — including Featured Listings, AI-powered match boosts, premium data exports, and enhanced visibility — are clearly priced before checkout. Pricing may vary by country, category, and duration. Prices displayed may include or exclude VAT (value added tax) depending on the user’s location and applicable law. Where reverse charge applies (typically for business users registered for VAT in another EU member state), this will be indicated at checkout. It is the business user’s responsibility to ensure correct VAT treatment in their jurisdiction.

TenderMap reserves the right to update pricing at any time. Users are informed of the applicable price at the point of purchase. Continued use of a paid feature after a price change constitutes acceptance of the new rate. Payments are processed by third-party payment service providers (including Stripe). TenderMap does not store full payment card details. All payment transactions are subject to the terms and privacy policies of the relevant payment processor.

7. Refund Policy

All fees paid to TenderMap - including listing fees, AI feature subscriptions, Featured Listing boosts, and any other charges - are non-refundable once payment has been processed, unless otherwise required by applicable law.

This applies regardless of whether the service has been used, partially used, or has not yet appeared on the platform. Users should carefully review their selections before completing a purchase.

Exceptions apply only where required by mandatory consumer protection laws in the applicable country. Where EU consumer rights directives provide a 14-day cooling-off period for digital services, this period applies only where the service has not yet commenced. By purchasing any digital service on TenderMap and requesting immediate access or activation, you expressly consent to immediate performance of the service and acknowledge that you waive your right of withdrawal once the service has begun. TenderMap will confirm this waiver at the point of purchase. TenderMap will communicate any applicable statutory rights to users in the relevant jurisdictions.

8. Multi-Country Operations

TenderMap operates in Latvia, Sweden, Estonia, Lithuania, Finland, Norway, Denmark, and Germany. The following country-specific notes apply:

  • EU Member States (Latvia, Sweden, Estonia, Lithuania, Finland, Denmark, Germany): Users benefit from full EU consumer protection standards, GDPR rights, and applicable e-commerce directive protections. EEA Countries (Norway): Norway participates in the EEA agreement and is treated equivalently to EU member states for the purposes of these Terms, including GDPR compliance and consumer rights, except where EU law does not directly apply under the EEA framework.
  • Public procurement tenders: Users must independently verify the authenticity and current status of any public tender listed on TenderMap with the issuing authority. TenderMap is a discovery and matching tool, not an official procurement portal.

9. User Responsibilities

You agree not to:

  • Misuse the Platform, post illegal or abusive content, or infringe on others' rights.
  • Attempt to scrape, reverse-engineer, or extract data from the Platform by automated means without prior written consent.
  • Manipulate AI features, rankings, or search results through artificial means.
  • Use the Platform to send unsolicited commercial communications.

You are responsible for all actions taken under your account.

10. Limitation of Liability & Disclaimers

TenderMap is a technology platform and marketplace that connects buyers and suppliers in the construction and public procurement sectors. TenderMap is not a party to any agreements between users and does not act as an agent, broker, or contractor. All contracts and obligations arising from interactions facilitated through the Platform are solely between the relevant users. We do not guarantee the accuracy, completeness, or outcome of any tender or supplier interaction facilitated through the Platform.

To the maximum extent permitted by applicable law, TenderMap is not liable for: user conduct; listing errors; losses arising from reliance on AI-generated content; data from third-party APIs (including public tender databases); or any indirect, incidental, or consequential damages.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

11. Intellectual Property

All Platform content - including the TenderMap brand, AI models, software, design, data compilations, and documentation - is the property of SIA BMAP or licensed to us. You may not copy, reproduce, or reuse our content without written permission.

User-submitted content remains your property, subject to the licence granted in Section 3.

12. Privacy & Data Usage

Our Privacy Policy explains how we collect, use, and protect your personal data. We process data in compliance with GDPR and applicable national data protection laws in each country where we operate.

13. Termination

You can delete your account at any time from your account settings. We reserve the right to suspend or terminate accounts or listings for violations of these Terms, or where required by applicable law, without liability to you.

Upon account deletion, your data is handled in accordance with our Privacy Policy and applicable legal retention requirements.

14. Changes to Terms

We may update these Terms from time to time. Where changes are material, we will provide at least 14 days' notice via email or a prominent Platform notification. Your continued use after the effective date of updated Terms constitutes acceptance.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Latvia. Disputes will be resolved by Latvian courts, unless otherwise required by mandatory law.

  • Consumer protection override: If you are a consumer resident in an EU or EEA member state, the mandatory consumer protection laws of your country of residence apply in addition to these Terms and cannot be excluded by contract. You may bring claims against TenderMap in the courts of your country of residence.
  • EU Online Dispute Resolution (ODR): Consumers in the EU and EEA may submit disputes to the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/ - TenderMap’s contact email for ODR purposes is [email protected]. TenderMap is not obligated to participate in alternative dispute resolution procedures unless required by applicable law.

16. Listing Duration & Lifecycle

All listings published on TenderMap are active for 30 days from the date of publication. Prior to expiry, TenderMap will send reminder notifications to the listing owner. After 30 days, listings are automatically moved to draft status and are no longer publicly visible. Users may republish a draft listing at any time subject to the applicable terms and fees at that time. TenderMap reserves the right to remove or permanently delete listings that violate these Terms, without prior notice or refund.

17. Language

These Terms may be made available in multiple languages as a courtesy to users. In the event of any conflict or discrepancy between translated versions, the English language version shall prevail and be the legally binding version.
